These Terms and Conditions (“Terms”) govern your access to and use of the NotaryPro Academy website (notaryproacademy.com) and all courses, materials, and services offered through it (collectively, the “Platform”). By creating an account, purchasing a course, or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
NotaryPro Academy is a privately owned California education provider. References to “NotaryPro Academy,” “we,” “us,” or “our” refer to the legal business entity operating this Platform.
1. Course Access
Upon purchase, you will receive access to your enrolled course for the period specified on the individual course page at the time of purchase. Please review the course listing carefully before completing your purchase. NotaryPro Academy is not responsible for access that lapses due to inaction on the student’s part.
Course access is personal and non-transferable. You may not share your login credentials with any other person. Each student must have their own account.
2. California Notary Education
NotaryPro Academy provides notary education courses designed to fulfill the mandatory education requirements for California notary public applicants and renewal candidates under California Government Code § 8201 and § 8201.2.
Important: NotaryPro Academy is a privately owned education provider. We are not the California Secretary of State and are not affiliated with or endorsed by any government agency. Completion of a NotaryPro Academy course fulfills the education requirement but does not guarantee that you will pass the state examination, receive a commission, or be approved by the California Secretary of State. Final commission approval is determined solely by the California Secretary of State.
The California Secretary of State course approval number and approval date for each course are displayed on the respective course page. NotaryPro Academy courses are offered pursuant to 2 Cal. Code of Regulations § 20800 et seq.
3. Account Usage
- You must be at least 18 years of age to create an account and purchase a course.
- You must be a legal California resident or otherwise eligible to apply for a California notary commission under Government Code § 8201.
- Accounts are for individual use only. Sharing, transferring, or selling your account or login credentials is strictly prohibited and will result in permanent account termination without refund.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must register using your full legal name exactly as it appears on your government-issued photo ID. Your certificate of completion will be issued in the name on your account.
4. Completion Requirements and Certificate Issuance
A Certificate of Completion will be issued only after all of the following conditions are satisfied:
- All lesson modules have been completed in sequential order
- The minimum required instructional time has been met and verified (6 hours for the new applicant course; 3 hours for the renewal course)
- The required practice assessment has been completed
- A valid government-issued photo ID has been submitted and verified
Certificates are issued as downloadable PDF documents and are valid for use with the California notary public application for two (2) years from the date of issuance, in accordance with California law.
5. Payments
All payments are processed securely at checkout. Prices are displayed in U.S. dollars. By completing a purchase, you authorize the charge to your selected payment method.
We do not store full payment card numbers. Payment processing is handled by our third-party payment processor.
All sales are final once a course has been accessed. See our Refund Policy for eligibility details.
6. Refunds
Our Refund Policy is incorporated into these Terms by reference. Refunds are available only if you have not accessed or begun the course and you submit your request within 7 calendar days of purchase. Once any portion of the course has been accessed, no refund will be issued. Please review the full Refund Policy at notaryproacademy.com/returns before purchasing.
7. Technology Requirements
You are responsible for ensuring you have:
- A stable internet connection
- A device (computer, tablet, or smartphone) capable of running a modern web browser
- A government-issued photo ID for identity verification before certificate issuance
NotaryPro Academy is not responsible for technical difficulties caused by your device, internet connection, browser, or operating system.
8. Prohibited Conduct and Academic Integrity
The following conduct is strictly prohibited and will result in immediate account termination without refund and may be reported to the California Secretary of State:
- Submitting false or fraudulent identity documents
- Allowing another person to access or complete the course on your behalf
- Attempting to falsify, manipulate, or bypass time-tracking or lesson completion systems
- Sharing course content, materials, or assessments with any third party
- Reproducing, distributing, or reselling any course content without written permission
The California Secretary of State may be notified of any attempted fraud in connection with state-regulated notary education.
9. Intellectual Property
All course content, materials, videos, workbooks, templates, assessments, and other resources made available through the Platform are the intellectual property of NotaryPro Academy and are protected by United States copyright law. Your purchase grants you a limited, personal, non-transferable, non-sublicensable license to access and use course materials for your own personal notary education purposes only.
You may not copy, reproduce, distribute, publish, display, modify, create derivative works from, or commercially exploit any course content without the prior written permission of NotaryPro Academy.
10. Disclaimer of Warranties
THE PLATFORM AND ALL COURSE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NOTARYPRO ACADEMY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
COURSE CONTENT IS PROVIDED FOR EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL ADVICE. FOR SPECIFIC LEGAL QUESTIONS, CONSULT A LICENSED CALIFORNIA ATTORNEY.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOTARYPRO ACADEMY AND ITS OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR THESE TERMS, EVEN IF NOTARYPRO ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO NOTARYPRO ACADEMY IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless NotaryPro Academy and its officers, employees, agents, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your submission of false or fraudulent information.
13. Dispute Resolution
Before initiating any formal legal action, you agree to contact NotaryPro Academy in writing at info@notaryproacademy.com to attempt to resolve any dispute informally. We will respond within 15 business days.
If the dispute cannot be resolved informally, any claim or dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by JAMS in Contra Costa County, California, under its applicable rules, except that either party may seek injunctive or other equitable relief in court to prevent infringement of intellectual property rights.
Notwithstanding the foregoing, nothing in this section limits any rights you may have under California consumer protection law, including the right to file a complaint with the California Department of Consumer Affairs or the California Attorney General.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California (Cal. Civil Code § 1646), without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Contra Costa County, California, and you consent to personal jurisdiction in those courts.
15. Modifications to These Terms
NotaryPro Academy reserves the right to update these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date. Material changes will be communicated to enrolled students by email. Your continued use of the Platform after a Terms update constitutes acceptance of the revised Terms.
